Many South African businesses are unaware that energy efficiency improvements can generate significant tax benefits through Section 12L of the Income Tax Act. The incentive encourages organisations to invest in projects that reduce energy consumption and improve operational efficiency. Businesses can currently claim 95 cents per kilowatt-hour (kWh) of verified energy savings achieved through qualifying energy efficiency interventions.
The incentive applies to energy savings achieved through measures such as efficient motors and drives, variable speed drives (VSDs), compressed air optimisation, boiler and steam system upgrades, heat recovery systems, building energy management systems, manufacturing process optimisation, and logistics and fleet efficiency improvements.
To qualify, companies must establish an energy baseline and verify savings using a SANAS-accredited Measurement and Verification (M&V) body in accordance with SANS 50010 standards. The verified savings are submitted to SANEDI, which issues a tax certificate that can be used when filing with SARS.
Recent National Treasury proposals extend the incentive until 31 December 2030, providing businesses with additional certainty to invest in energy efficiency projects.
The 12L Claim Process
- Identify and implement an energy efficiency project.
- Establish an energy baseline.
- Appoint a SANAS-accredited M&V body.
- Conduct 12-month performance assessment.
- Submit verified savings to SANEDI.
- Receive Section 12L Tax Certificate.
- Submit certificate with SARS tax return.
- Claim tax deduction.

Example Calculation
A manufacturing facility that achieves verified savings of 2 million kWh per year could potentially qualify for:
2,000,000 kWh × R0.95 = R1,900,000 tax deduction value
Actual tax benefits will depend on the company's tax position and verified savings.
